Stueve Siegel Hanson Secures Class Certification of CA, NY, NJ Overtime Claims for Travel Nurses

In a significant victory for travel nurses, Stueve Siegel Hanson recently secured certification of multiple state law classes against Fastaff, LLC for unpaid overtime wages. At the time of the Order, the firm already represented several thousand nurses under the related federal Fair Labor Standards Act in the case.

The nurses allege Fastaff’s expense reimbursement practices are actually a scheme to disguise wages and avoid overtime obligations. Specifically, Fastaff’s housing and meal stipends to travel nurses function as wages because, for example, they vary with the number of shifts the nurse works and are not connected to whether the nurse is incurring expenses on the company’s behalf while away from home.

In a ruling issued September 30, 2025, the U.S. District Court for the District of Colorado granted class certification for three state-specific overtime claims covering nurses who worked daily or weekly overtime in California, New York, and New Jersey. This Order will allow these nurses to consolidate their resources and press these claims in a single proceeding.
