Benjamin J. Stueve

Benjamin J. Stueve represents consumers, employees, businesses, and agricultural producers in complex litigation nationwide. His practice includes privacy and data breach class actions, employment disputes, agricultural technology and dairy litigation, insurance cases, and other commercial matters.

Ben manages litigation from pre-suit investigation through resolution, including dispositive motions, discovery strategy, electronic discovery, expert coordination, settlement negotiations, and trial preparation. He has argued before the Kansas Supreme Court and regularly handles significant motion practice in state and federal courts.

Before joining Stueve Siegel Hanson, Ben practiced at Stinson LLP, representing corporate clients in complex litigation. Before entering private practice, Ben served as a term law clerk to U.S. District Judge Stephen R. Bough of the United States District Court for the Western District of Missouri. Those experiences give him insight into how courts evaluate disputed issues and how defendants assess litigation risk.

Before law school, Ben taught English in public and private schools. He credits teaching with sharpening his ability to explain complicated issues clearly and with shaping the client-centered approach he brings to his practice.

Outside of his practice, Ben enjoys spending time with his wife and three children, including coaching his daughter’s flag football team and passing on his Eagle Scout experience as a cub scout leader in his son’s Pack.

Data Breach & Privacy Litigation

Ben represents consumers in complex data breach and privacy litigation nationwide. He has substantial experience managing dispositive briefing, discovery disputes, electronic discovery negotiations, depositions, settlement proceedings, and coordination among leadership counsel.

Representative Matters

• Mr. Cooper Data Breach Litigation (N.D. Tex.)
  Represents consumers in nationwide litigation arising from a cyberattack that exposed the personal information of nearly 15 million customers, including Social Security numbers, bank account information, and dates of birth. Ben leads case strategy, discovery, electronic discovery negotiations, briefing, and deposition preparation while coordinating closely with co-lead counsel.

• UC San Diego Health Data Breach Litigation (San Diego Cty. Cal. Super. Ct.)
  Represented patients whose sensitive personal and medical information was compromised in a healthcare data breach. Ben handled dispositive motion briefing, helped guide the settlement approval process, and oversaw implementation of a settlement that provided relief to affected patients.
• LifeBridge Data Breach Litigation (Md. Ct., Balt. City)
  Represented patients affected by a healthcare data breach that exposed sensitive personal and medical information, including names, addresses, dates of birth, diagnoses, treatment information, insurance data, and, for some individuals, Social Security numbers. Ben handled briefing and litigation related to settlement proceedings in the case, which ultimately resulted in a court-approved class settlement for affected patients.

Agricultural Technology Litigation

Represents dairy producers in litigation involving robotic milking systems and other agricultural technologies that allegedly failed to perform as represented. Ben has helped represent farmers in disputes against some of the industry's largest manufacturers of automated dairy equipment, including matters involving discovery, motion practice, expert coordination, and case strategy. These efforts have contributed to significant recoveries for dairy producers, including a $55 million settlement on behalf of dairy farmers who purchased DeLaval robotic milking systems and a settlement valued at more than $120 million involving Lely robotic milkers. Ben currently serves as case manager in several pending agricultural technology matters involving milking equipment manufacturers and related technology providers.

Employment Litigation

Ben represents employees in litigation and arbitration involving workplace and compensation disputes. He manages matters through discovery, depositions, briefing, settlement negotiations, and resolution.

Representative Matters

• FastStaff Litigation (D. Colo.)
  Represents travel nurses in a class action alleging that a healthcare staffing company improperly reduced overtime compensation through the use of per diem payments and other compensation practices. Ben handles briefing, corporate representative depositions, plaintiff preparation, and discovery strategy on behalf of the nurses.
• AYA Employment Arbitration
  Represented healthcare professionals in an employment dispute involving compensation-related claims. Ben directed discovery efforts, managed depositions, and helped achieve a successful resolution for the clients.

Business, Commercial & Insurance Litigation

Ben handles complex business and insurance disputes at both the pretrial and trial stages. His experience includes dispositive briefing, motions in limine, jury instructions, witness preparation, cross-examination strategy, and courtroom support.

Representative Matters

• Kansas City Life Cost-of-Insurance Litigation (Jackson Cty. Mo. Cir. Ct.)
  Served as a key member of the trial team that secured a multimillion-dollar jury verdict on behalf of policyholders. Ben managed dispositive briefing, pretrial filings, jury instructions, and trial-level legal research, and successfully argued jury-instruction issues before the court. Ben has also contributed to cost-of-insurance matters involving USAA, Genworth, Symetra, and other insurers.
• Estate of Norman C. Skalicky Litigation (Hennepin Cty, Minn. Dist. Ct.)
  Ben was involved from the beginning of this complex contested estate litigation. He managed client communications, discovery negotiations, dispositive motions, mediation strategy, and post-mediation proceedings, and successfully argued issues concerning attorneys’ fees.
