Gordmans' Unpaid Overtime Wages / Assistance Store Manager Misclassification Lawsuit

Stueve Siegel Hanson LLP and Shavitz Law Group, P.A. have filed a lawsuit seeking unpaid overtime wages on behalf of Assistant Store Managers employed by Gordmans Stores, Inc., a national apparel and homewares retailer.  The lawsuit alleges that Gordmans maintains a practice and policy of denying overtime wages to its Assistant Store Managers by misclassifying them as “exempt” from applicable state and federal overtime laws, including the Fair Labor Standards Act (“FLSA”).

The lawsuit seeks certification under the FLSA of a collective action class comprised of similarly-situated Assistant Store Managers.  The lawsuit is captioned Joshua W. Merchant v. Gordmans Stores, Inc. and was filed February 17, 2016 in the U.S. District Court for the Eastern District of Missouri.
