Automotive Defects and Car Accidents

Automotive manufacturers have the duty to design cars and trucks that are safe. When a vehicle is carelessly and improperly designed or manufactured, a collision in that vehicle can cause life-changing, catastrophic injuries. This occurs far too often; it’s estimated that mechanical defects account for up to 15 percent of automobile accidents each year.

  • Berry, et al. v. Volkswagen of America, Inc. Pursued a Missouri statewide class action on behalf of consumers who purchased certain models of Volkswagen vehicles with defective window regulators and/or plastic window clamps. Under the settlement, Volkswagen agreed to reimburse all repair expenses.
  • Lewin, et al. v. Volkswagen of America, Inc. Served as co-lead counsel in a nationwide class action against Volkswagen for defective window regulators installed on nearly one million vehicles. Under the settlement, Volkswagen agreed to reimburse all repair expenses, install a redesigned metal window regulator and provide an extended warranty for the repaired parts.
  • Gutzler, et al. v. General Motors. Brought a class action on behalf of consumers who purchased or leased certain GM vehicles that were factory-filled with a GM coolant. Plaintiffs alleged that the vehicles, as well as the coolant, were defective, causing sludging of the cooling systems and gasket failures. Settlements were approved for both Missouri and national class members.
  • Tadken v. Mitsubishi Motor Sales of America, Daily v. Daimler Chrysler Motors Corp. Brought a nationwide class action that resulted in final court approval of a settlement valued at $33 million. The case settled claims alleging breach of express and implied warranty and deceptive trade practices arising out of the allegedly defective rims installed on approximately 35,000 vehicles.

Our firm also pursues litigation against negligent drivers. In one recent case, we represented the family of a man who was killed when his car was struck by a runaway two-ton trailer. The lawsuit claimed the defendant company failed to properly inspect the trailer and its connection to a towing truck. Within weeks of trial, we reached a favorable settlement.
