$1.6 Million Settlement Reached in Texting While Driving Pedestrian Death

11.19.2012

Stueve Siegel Hanson reached a settlement in a negligence and punitive damages lawsuit against a college student who was texting while driving an Audi A4 sports car.  The claim was brought on behalf of the wife of a Kansas City resident who was struck and killed by the texting driver while he was in a crosswalk at 31st & Main in Kansas City, Missouri.

Our investigation showed that the defendant driver was texting while she was making a left turn through a busy intersection.  Although the driver had an unobstructed view, video evidence of the intersection documented that the driver accelerated into the intersection, through the crosswalk and into the pedestrian without braking.
