Kate Marshall

Kate Marshall represents consumers, workers, farmers and businesses in complex litigation nationwide. Her experience spans consumer and privacy class actions, employment disputes, antitrust litigation, healthcare and pharmaceutical matters, and high-stakes agricultural and commercial cases.

A significant part of Kate’s practice has involved litigation on behalf of dairy farmers who invested in robotic milking technology that allegedly failed to perform as represented. She worked on the firm’s litigation involving DeLaval’s VMS Classic and Lely’s Astronaut A4 systems, assisting with document review and deposition preparation in cases that ultimately resulted in nationwide settlements valued at $55 million and approximately $122 million, respectively. Kate has continued working with the firm’s agricultural litigation team in matters involving DeLaval’s V300 system and robotic milking technology manufactured by GEA and Galaxy, contributing to factual development, legal research and briefing. She also has worked on matters involving BouMatic systems and other dairy-related disputes.

Kate’s work also reflects the evolving intersection of technology and consumer privacy. She assisted in the multidistrict litigation arising from the Capital One data breach, which involved allegations that the confidential information of nearly 100 million credit applicants was compromised. More recently, she has worked on the firm’s litigation against General Motors involving allegations that the automaker collected and sold driving data obtained through its OnStar telematics system. Her experience in these matters includes working through substantial factual records and helping develop the legal arguments underlying complex, nationwide claims.

In employment litigation, Kate has represented workers across industries and employment structures. Her experience includes litigation on behalf of DIRECTV satellite installation technicians alleging misclassification and failures to pay minimum wage and overtime, as well as cases challenging staffing agencies’ alleged practice of reducing travel nurses’ agreed-upon pay rates after they committed to assignments and other wage-and-hour violations. She also has worked on litigation involving healthcare workers at Envision Healthcare alleging they were not compensated for all hours worked.

Kate has also contributed to significant antitrust, pharmaceutical and healthcare litigation. Her work has included the firm’s representation of Associated Wholesale Grocers in litigation alleging a price-fixing conspiracy among major packaged seafood and canned tuna producers, as well as EpiPen antitrust litigation involving claims brought on behalf of drug wholesalers. She has worked on additional pharmaceutical and healthcare matters involving Gilead, Centene and Fidelis Care, including disputes involving prescription-drug costs and rebates.

Before becoming a lawyer, Kate studied art history, an interest that shaped her early legal experience. While attending the University of Kansas School of Law, she served as a legal extern through the University of Kansas General Counsel’s Office for the Spencer Museum of Art, where she worked on contracts, licensing, intellectual property and First Amendment issues. She also served as a research assistant to Professor Michael Hoeflich, conducting research in copyright and art law.
