Lawsuit Against Rush Street Gaming for Minimum Wage Violations

A class and collective action lawsuit has been filed against Rush Street Gaming, LLC and one of its subsidiary casinos for failing to pay its tipped employees properly under federal and state wage laws. The case seeks to represent employees at:

  • Rivers Casino in Des Plaines, Illinois;
  • Rivers Casino in Pittsburgh, Pennsylvania;
  • Rivers Casino in Philadelphia, Pennsylvania; and
  • Rivers Casino in Schenctady, New York.

The complaint alleges that Rush Street Gaming and its casinos violated tipped employees’ rights by (1) failing to pay minimum wage and claiming a tip credit without providing a valid tip credit notice; and (2) deducting the cost of dry-cleaning employer-required uniforms from tipped employees’ wages.

Employees may be eligible to participate in this case if they meet the following criteria:

  1. Worked at the following Rush Street Gaming casinos during the previous three years: Rivers Casino in Des Plaines, Illinois; Rivers Casino in Pittsburgh, Pennsylvania; Rivers Casino in Philadelphia, Pennsylvania; and Rivers Casino in Schenctady, New York.
  2. Were paid a direct cash wage (i.e., the amount paid by the casino not counting tips) of $7.24 or less and/or had the cost of dry-cleaning an employer-required uniform deducted from their wages.
