NBEO Data Breach Lawsuit

On July 14, 2017, Stueve Siegel Hanson filed its second class action lawsuit against the National Board of Examiners in Optometry (NBEO), the primary testing organization in the field of optometry in the United States. The lawsuit alleges that NBEO, or a party within its control, suffered a data breach involving the Personal Information of thousands of prospective and practicing optometrists.

The breach was discovered in July 2016 when many optometrists across North America began learning that fraudulent Chase Amazon Visa credit cards were being opened in their names. Affected individuals had given detailed personal identifying information to NBEO, including Social Security numbers and dates of birth, to register for its exams, some more than 15 years ago. The suit alleges that NBEO was negligent in failing to secure or delete this personal information, and failed to timely notify victims of the breach.

The NBEO has denied responsibility for the breach even in the face of overwhelming evidence it is the source.

Stueve Siegel Hanson earlier filed a lawsuit against NBEO that was dismissed when the Court found that the named plaintiffs lacked standing to sue. That dismissal is currently on appeal.
