BOA Mortgage Origination Employees Wage and Hour Litigation
Stueve Siegel Hanson has filed a collective action lawsuit on behalf of all Bank of America (BOA) mortgage origination employees whose positions were misclassified as exempt from the FLSA minimum wage and overtime requirements. This includes those employees whose positions include Retail Sales Managers, Account Executives, LoanLine Sales Managers, Sales Leaders, Managers NCS Production, LoanLine Sales Assistant Managers, Renovation Loan Originators, Mortgage Loan Specialists, Mortgage Loan Officers, Senior Mortgage Loan Officers and Mortgage Loan Associates (collectively "Loan Originators").
The lawsuit alleges that BOA failed to pay mortgage origination employees for overtime worked. In particular, these employees were required to perform work in excess of eight hours per day and/or forty hours per week, and were not paid overtime. The defendant illegally classified these employees as exempt from overtime and minimum wage requirements. This is in violation of the Federal Labor Standards Act (FLSA), the Illinois Wage and Hour Laws, and other state labor laws nationwide.
The judge granted conditional certification of two subclasses in December 2013, and notice was mailed to eligible employees on February 12, 2014.
