Hyundai Tiburon Class Action Settlement Reached

Stueve Siegel Hanson LLP is lead counsel in a lawsuit against Hyundai Motor America alleging that Hyundai marketed and sold vehicles with defective flywheel systems. We represent residents of various states, including California, who purchased a new or used manual-transmission 2003 Hyundai Tiburon. After purchasing their Tiburons, plaintiffs each experienced problems shifting into and between gears and spent thousands of dollars in replacement parts and repairs.

Settlement Announced

The plaintiffs and Hyundai have agreed on a settlement which - if approved by the court - will provide cash reimbursements to eligible class members. The Court will decide whether to approve the settlement after the "Fairness Hearing," which is scheduled for June 28, at 11 a.m.

Class members are all current and former owners and lessees of a manual-transmission 2003 Tiburon GT, produced on or before April 1, 2003, who paid for a replacement to the flywheel assembly, clutch disk assembly, clutch cover assembly, or clutch release bearing within the applicable warranty period. The warranty period is 10 years or 100,000 miles (or 5 years/60,000 miles if purchased used).

Terms of Settlement

Under the proposed settlement, eligible class members would receive cash reimbursements for money spent on certain flywheel/clutch parts repairs to their 2003 Hyundai Tiburons. The reimbursement amount will be based on the amount spent and the vehicle mileage at the time of the repairs:

  • For vehicles with up to 50,000 miles at the time of repair, the reimbursement will be 100% of the amount paid for the repair.
  • For vehicles with between 50,001 and 75,000 miles at the time of repair, the reimbursement will be 75% of the amount paid for the repair.
  • For vehicles with between 75,001 and 100,000 miles at the time of repair, the reimbursement will be 50% of the amount paid for the repair.

Class members will be eligible to receive up to $150 in rental expenses for each flywheel / clutch repair.

Who is eligible for reimbursement?

The Notice of Class Action Settlement and Settlement Claim Form have been sent to class members, who can now submit claims to receive reimbursements. The Class Notice provides more information about the lawsuit, class members' legal rights, and details of the settlement including class member eligibility and how to receive available benefits by using the Claim Form. Eligible class members must submit a Settlement Claim Form by October 26, 2010.
