OVERVIEW OF THE CASE AND ONGOING INVESTIGATION
Stueve Siegel Hanson LLP, Donelon, PC, and Brown & Associates filed a collective action lawsuit on behalf of current and former bank tellers and personal bankers who worked for Bank of America within the past three years for unpaid wages - including overtime - under the Fair Labor Standards Act (FLSA).

We represent bank tellers and personal bankers in a wage and hour collective action against Bank of America, N.A. (BOA). The case is Brawner, et al. v. Bank of America, N.A., Case No. 09-CV-2073, and was filed in the United States District Court for the District of Kansas.
The lawsuit alleges that BOA failed to pay bank tellers and personal bankers for overtime worked. In particular, these employees consistently work more than forty hours in a work week, but instead of paying overtime, BOA: (i) gives them "comp time," (ii) tells them not to record the hours worked over forty, and/or (iii) lowers or "modifies" the tellers' recorded hours by eliminating any overtime hours. Also, the lawsuit alleges that BOA automatically deducts time for meal breaks; however, employees were routinely required to perform work during unpaid meal breaks (or were not able to take such breaks).
