APAC Customer Services, Inc. Lawsuit

OVERVIEW OF THE CASE AND ONGOING INVESTIGATION

Stueve Siegel Hanson LLP and Lear Werts LLP have filed a collective action lawsuit on behalf of APAC call center employees for unpaid wages.

We represent call center employees in a wage and hour class action against APAC Customer Services, Inc. The case was filed as Sharpe, individually, and on behalf of all other similarly situated individuals who consent to become Plaintiffs v. APAC Customer Services, Inc., Case No. 09-CV-329 in U.S. District Court for the Western District of Wisconsin. The lawsuit alleges that APAC consistently violates federal and state wage and hour laws by failing to accurately record all time worked and failing to pay earned wages and overtime for employees at its La Crosse, Wisconsin facility. Examples of the unlawful practices claimed include requiring employees to work "off the clock" by not paying for work performed pre-shift, post-shift, and over unpaid meal breaks. These tasks include such activities as booting up computers, logging on to APAC's network, opening relevant computer programs, reviewing company memoranda and e-mail, and completing other essential tasks. The workers are seeking collective action status. We are also investigating CenturyTel's compensation practices at other call centers located in Tucson, Arizona, Davenport, Iowa, Schaumburg, Illinois, Green Bay, Wisconsin, Wilmington, North Carolina, Cedar Rapids, Iowa, Tampa, Florida, Newport News, Virginia, Corpus Christi, Texas, Utica, New York, and other states. CASE UPDATE

On June 16, 2010, the Court approved the settlement of this matter. On or about July 16, 2010, a Notice and Claims Administration Form will be mailed out to eligible Customer Service Representatives explaining the settlement and how workers who have not already joined this lawsuit can participate in the settlement. For those individuals who have already joined the lawsuit, you will receive a letter and claims administration form from our office explaining what you need to do to receive your share of the settlement proceeds. In the meantime, please be sure to keep us informed of any changes to your contact information by submitting the updated information below. 

On January 8, 2010, The United States District Court for the Western District of Wisconsin granted conditional certification to a class of all telephone dedicated customer service representatives employed by APAC in Tucson, Arizona; Tampa, Florida; Cedar Rapids, Iowa; Davenport, Iowa; Utica, New York; Corpus Christi, Texas; Green Bay, Wisconsin; or La Crosse, Wisconsin within the last three years.  Click HERE to view the Court's order.
