OVERVIEW OF THE CASE
Stueve Siegel Hanson LLP and Lear Werts LLP filed a class action lawsuit on behalf of non-exempt hourly employees (including claims processors, claims service assistants, claims representatives, underwriters and customer service representatives) at State Farm Operations Centers for unpaid wages and overtime. The court recently conditionally certified this case to proceed as a collective and class action.

Background
Stueve Siegel Hanson, along with our co-counsel, represents current and former non-exempt employees in a wage and hour collective action against State Farm Insurance. The case is Lisa Nobles et. al v. State Farm Mutual Automobile Insurance Company. The lawsuit alleges that State Farm violates federal and state wage and hour laws by failing to accurately record all time worked and failing to pay earned wages and overtime. State Farm consistently requires many hourly employees to engage in numerous preparatory activities, as well as related work activities performed during breaks, that are integral and indispensable for them to perform their duties. These tasks include such activities as booting up computers, logging on to State Farm's network, opening relevant computer programs, reviewing company memoranda and e-mail, and completing other essential tasks. The lawsuit alleges that it is State Farm's policy and practice not to pay these employees for this work time, and consequently they were consistently working off-the-clock (such as pre-shift work, post-shift work and unpaid lunches) and without pay.
