Pizza Delivery Driver Cases

OVERVIEW OF THE CASE AND ONGOING INVESTIGATION

Stueve Siegel Hanson LLP and Weinhaus & Potashnick are filing collective and class action lawsuits on behalf of pizza delivery drivers against many of the nation's pizza franchises and their franchisees for unpaid wages and unreimbursed expenses. So far, the firms have filed cases against Pizza Hut, NPC, WKRP, Tumbleweed, Papa John's, Essential Pizza and Domino's.

THE LAWSUITS

We represent pizza delivery drivers in company-wide wage and hour collective and class actions against several large pizza companies, including: Pizza Hut, Inc.; NPC International, Inc., which is the largest Pizza Hut franchisee in the country; WKRP Management, LLC, which operates approximately 44 Pizza Hut stores in Colorado, Kansas, New Mexico and Wyoming; Tumbleweed Pizza Partners, Inc., which operates approximately 26 Pizza Hut Stores in Texas; Papa John's, Inc.; and Essential Pizza, Inc. d/b/a PJCOMN, which operates approximately 82 Papa John's stores in Colorado and Minnesota. Additionally, we represent pizza delivery drivers in a New York wage and hour class and collective action against Domino's, Inc. The NPC lawsuit was filed in the United States District Court for the District of Kansas; the Pizza Hut, WKRP and Essential lawsuits in the United States District Court for the District of Colorado; the Tumbleweed lawsuit in the United States District Court for the Northern District of Texas; the Papa John's lawsuit in the United States District Court for the Eastern District of Missouri; and the Domino's lawsuit in the United States District Court for the Eastern District of New York.

The lawsuits allege that these pizza companies violate federal (and state) wage and hour laws by failing to reimburse their pizza delivery drivers for their automobile and other job-related expenses, resulting in the pizza delivery drivers being paid less than minimum wage. Specifically, the lawsuits allege that the amount paid by the pizza companies to pizza delivery drivers for automobile expenses are insufficient to reimburse them for their actual expenses, including purchasing gasoline, vehicle parts and fluids, automobile and repair services, and automobile insurance, and suffering automobile depreciation. Further, the lawsuits allege that the pizza companies wholly failed to reimburse their pizza delivery drivers for other job-related expenses, including the purchase of cell phone services, uniforms, dry cleaning and laundering services, and maps, flashlights and batteries. The pizza delivery drivers are seeking collective and class action status.
