MidFirst Bank Overdraft Fees Lawsuit

Stueve Siegel Hanson, LLP, Gray Ritter & Graham, P.C., Tycko & Zavareei LLP, and Sneed Lang Herrold PC have filed a lawsuit against MidFirst Bank alleging that the plaintiff, and other MidFirst Bank customers who are citizens of Oklahoma, were charged overdraft fees because of MidFirst Bank's unfair and deceptive overdraft fee practices. The lawsuit alleges that these practices violate Oklahoma's consumer protection law and MidFirst Bank's contracts with its customers.

The plaintiff alleges, among other things, that MidFirst Bank: (a) engaged in a systematic policy of re-ordering debit card transactions from highest dollar amount to lowest dollar amount so as to deplete the customer's available funds as quickly as possible while maximizing the number of overdraft fees; (b) charged overdraft fees even in situations where in fact a customer did not overdraw his or her checking account; (c) failed to disclose or properly disclose its overdraft policies; and (d) provided false and misleading account balance information on the bank's website or at the point of sale.
