The Court recently certified this case as both a nationwide Federal Labor Standards Act (FLSA) collective action on behalf of all forklift operators who worked for UTi at any time since March 18, 2008, and as an Illinois state law class action on behalf of all forklift operators employed in the state of Illinois since September 2004. A Notice informing potential class members about the FLSA case and their right to join was mailed to eligible forklift operators, and the deadline to participate in ths lawsuit has passed.
Background of the Case
The law firms of Stueve Siegel Hanson LLP and Weinhaus & Potashnick filed a class and collective action lawsuit seeking unpaid regular and overtime wages on behalf of forklift drivers at warehouse and shipping facilities located across the country and operated by UTi Worldwide, Inc. and UTi Integrated Logistics, Inc. (together referred to as "UTi"). This case includes forklift operators who were employed directly by UTi or indirectly through a temporary staffing agency.
The lawsuit alleges that UTi Worldwide has consistently violated federal and Illinois state wage and hour laws by failing to pay its forklift drivers all earned wages and overtime and by failing to accurately record all time worked pre-shift and during unpaid lunch breaks. Examples of the alleged unlawful practices include requiring employees to work "off the clock" by not paying for pre-shift work such as locating and inspecting forklifts, putting on special clothing and protective gear, and logging into computer applications. Additionally, Plaintiffs allege that UTi has an illegal rounding policy that rounds away any and all time spent working before the start of the shift.
