Overview of the Case and Ongoing Investigation

The lawsuit alleges that Pulaski Bank failed to pay bank tellers and customer service representatives for unpaid wages and overtime worked at company bank branches. In particular, these employees were required to work pre-shift and post-shift. Examples of the alleged unlawful practices include preparing their cash drawers, obtaining supplies, logging in to Pulaski's computer systems, completing cash tickets, and preparing the drive-through. The lawsuit further alleges that Pulaski Bank required its tellers to continue working after the end of their paid shifts including cleaning up, microfilming bank documents, creating adding machine tapes, totaling and balancing checks with computer records, counting cash, verifying particular funds, balancing cash drawers, selling (transferring) excess cash to the bank vault, and assisting in opening of customer accounts. Additionally, when any cash drawer or accumulation of checks failed to balance, all tellers at the same branch were required to participate in additional efforts to balance the drawer and/or check total.
The lawsuit further alleges that Pulaski Bank required its customer service representatives to continue working after the end of their paid shifts including opening customer accounts, completing new account paperwork, copying documents, and sending forms to Pualaski's home office. Sometimes, customer service representatives were also required to continue working until all cash drawers and check totals balanced.
