Health Net Call Centers Overtime Lawsuit

Current Status of the Case

On February 23, 2011 the United States District Court for the Central District of California certified that this case could proceed as a class action under California state law and as a conditional collective action under the Federal Fair Labor Standards Act as to Plaintiff's claims that Health Net unlawfully rounded employees' time entries. A Notice was mailed on July 26, 2011 to all eligible call center workers detailing the case and explaining what action to take, if any, to be included. The case involves all Health Net Call Center workers employed by Health Net within the last four years in California, and within the last three years in other states nationwide.

Two different notices were sent to different call center workers:

• If you worked as a customer service representative in Health Net's call centers anywhere other than California and received a Notice including a "Consent to Join" form, the deadline to return the Consent to Join form was October 24, 2011 if you wanted to be included in the lawsuit.

• If you worked at one of Heath Net's California call centers within the last four years and received a Notice including a Consent to Join form and a request for exclusion form, you do not need to return the exclusion request form unless you do NOT want to be part of the California lawsuit. If you wanted to be part of the federal lawsuit, the deadline to return the Consent to Join form was October 24, 2011.

Background of the Case

Stueve Siegel Hanson LLP filed a class and collective action lawsuit on behalf of Health Net Call Center workers for unfair employment practices including unpaid overtime compensation, unpaid straight-time in California, and associated state law penalties.

We represent call center workers, including customer service representatives, in a wage and hour class and collective action against Health Net. The case is Eddings v. Health Net, Inc., Case No. 2:10-cv-01744-GHK-MAN (C.D. Cal.).  Individuals who have worked at Health Net call centers at any location nationwide in the last three years are eligible to participate.

The lawsuit alleges that Health Net violates federal and state wage and hour laws by unlawfully rounding its employees' time entries and consequently not adequately compensating them for the time they worked, including overtime.
