The law firms of Stueve Siegel Hanson LLP and Weinhaus & Potashnick have filed a class and collective action lawsuit seeking unpaid regular and overtime wages on behalf of hourly-paid employees who work in the foundry and manufacturing facility of Amsted Industries Incorporated and Amsted Rail Company, Inc. (Amsted) located in Madison County, Illinois.
The lawsuit alleges that Amsted has violated federal wage and hour laws by failing to pay its employees all earned wages and by failing to accurately record all time worked pre-shift and post-shift.

UPDATE: On June 16, 2010, the Court conditionally certified the claims in this case as an FLSA collective action. A Notice explaining the lawsuit was sent to all current and former hourly workers who were employed by Amsted in the Madison County, Illinois foundry and manufacturing facility anytime in the past three years. This time period to join the lawsuit has now passed.

The work duties that the Amsted workers at the Madison County, Illinois facility allege that they have not been paid for include:
(1) changing into and out of the required protective gear (fire-retardant and/or protective pants and jackets, protective sleeves, hoods, helmets with shields, goggles, ear plugs, respirators, gloves, metatarsal boots, and aprons);
(2) obtaining tools and supplies;
(3) starting and shutting down machinery equipment;
(4) testing tools and equipment;
(5) obtaining tool and equipment repairs and replacements;
(6) servicing tools and equipment;
(7) storing tools; and
(8) cleaning and preparing work areas for the next day or following shift.
The lawsuit has been brought under the federal Fair Labor Standards Act and is on behalf of current and former Amsted employees who are or were paid hourly at the Madison County, Illinois facility in the past three years.
